Welcome to Margarets Haven (hereinafter referred to as "Margaretshaven," "the Company," "we," "us," or "our"). This comprehensive Terms of Service Agreement (hereinafter referred to as "Terms," "Agreement," or "Terms and Conditions") constitutes a legally binding contract between you, the end user, purchaser, visitor, browser, subscriber, participant, and/or any other form of consumer (hereinafter collectively referred to as "you," "your," "user," "participant," or "customer"), and Margarets Haven regarding your access to and use of all components, features, services, content, tools, interfaces, platforms, domains, functionalities, data transmissions, and all other associated or derivative mechanisms which fall under the purview of our ownership or control.

These Terms govern your access to and usage of, without limitation, the official Margarets Haven website (inclusive of subdomains), mobile-optimized versions of such sites, software services, e-commerce purchasing tools, data entry portals, affiliate pages, third-party integrations, shipping infrastructures, and any other mode or medium of digital, physical, or hybrid interaction as they may exist now or in the future. This Agreement applies to all users without exception, and it governs all orders, transactions, inquiries, disputes, donations, exchanges, returns, and any other form of engagement.

If you do not agree to all terms, clauses, subsections, addenda, disclaimers, policies, conditions, or interpretive elements included or incorporated herein by reference, you are strictly prohibited from using or continuing to access the aforementioned services, purchasing goods, or engaging with any aspect of Margarets Haven. Your use constitutes explicit and unqualified agreement to be legally bound.

SECTION 1 – LEGAL ELIGIBILITY AND USER CRITERIA

1.1 Eligibility Criteria: The Services provided by Margarets Haven are strictly available only to individuals who are of legal age, defined as eighteen (18) years or older or the applicable age of majority in your jurisdiction of legal residence. You affirm, by accessing our Services, that you possess the legal right and capacity to enter into binding agreements under the applicable laws and statutes of your locality.

1.2 Exclusions: Individuals who are barred from receiving services under applicable jurisdictions due to prior violations of law, court order, sanctions, embargoes, civil disqualifications, or other limitations imposed by national, international, or regulatory authorities, may not use the Services. Margarets Haven reserves the unilateral right to deny service to any individual or entity for any reason or no reason at any time.

SECTION 2 – SHOPIFY PLATFORM USE AND LIMITATIONS

2.1 Platform Acknowledgment: Our storefront is hosted on the Shopify Inc. platform, which provides us with the online e-commerce infrastructure that enables the marketing, sale, and fulfillment of products and services. All transactions conducted through our website are processed via Shopify's secure and encrypted architecture, and the policies and limitations of Shopify may apply in addition to our internal policies.

2.2 Shopify Limitation Disclaimer: While we leverage Shopify to facilitate transactions and maintain digital storefront functions, Margarets Haven is solely responsible for all content, goods, marketing claims, business representations, legal policies, and consumer interactions featured or initiated through our Shopify-hosted website. Shopify does not hold any liability for order fulfillment, legal disputes, donation policies, or content accuracy.

2.3 Data Handling: By using our site, you acknowledge and consent that your information may be stored on Shopify’s servers, transmitted to and from various jurisdictions, and governed by both Shopify’s privacy terms and our own internal privacy policy.

SECTION 3 – MODIFICATIONS, UPDATES, AND AMENDMENTS

3.1 Right to Modify: Margarets Haven reserves the exclusive and non-contestable right to update, amend, suspend, terminate, revise, supplement, or delete any portion of these Terms at any time, with or without providing specific notice to users. Such changes shall become effective immediately upon publication to the designated Terms of Service page, which is the sole official location of this Agreement.

3.2 Continuing Acceptance: Your continued use of the Services following the implementation of any such modification constitutes full and irrevocable consent to the updated terms. You are responsible for reviewing this Agreement regularly to ensure that you remain in compliance.

SECTION 4 – ACCOUNT, TRANSACTION AUTHORIZATION, AND FRAUD

4.1 Account Responsibility: If you create an account, you are solely responsible for maintaining its security and confidentiality. Any activities under your account are presumed to be authorized by you.

4.2 Payment Methods: You authorize Margarets Haven, via Shopify or any integrated payment processor (including but not limited to PayPal, Stripe, Apple Pay), to charge your designated payment method in full for your purchase, including applicable taxes, shipping fees, and surcharges.

4.3 Fraud Monitoring: Margarets Haven reserves the right to flag, investigate, and cancel any order that is suspected to involve fraud, abuse, or chargeback risk. This includes orders placed with mismatched billing/shipping addresses, high-volume orders, or those failing fraud filters.

SECTION 5 – SHIPPING, DELIVERY, AND ORDER FULFILLMENT

5.1 Processing Time: Orders are generally processed within 3 to 7 business days, excluding weekends and public holidays. Delays during promotional periods or unforeseen supply chain interruptions may extend processing times.

5.2 Delivery Estimates: Shipping timelines vary by destination. Orders shipped within the U.S., Canada, U.K., and Australia typically arrive within 10–25 business days, while international orders may take 15–30 business days. These are estimated timeframes only.

5.3 Delivery Confirmation: Shipment is deemed delivered once tracking information indicates successful drop-off or receipt. In such cases, Margarets Haven bears no liability for stolen packages, delivery disputes, or claims of non-receipt.

5.4 Returned Mail: Orders returned due to insufficient address, refusal, or customs rejection will not be refunded unless previously approved by management. Re-shipment may require additional postage at the customer's expense.

SECTION 6 – FINAL SALE, RETURNS, REFUNDS, AND LIMITED WARRANTY

6.1 Final Sale Policy: All sales are final. By placing an order, you expressly waive your right to cancellation, refund, or return, except as expressly permitted in Section 6.2.

6.2 Exceptions: Refunds or replacements may be approved in our sole discretion only under the following circumstances: (i) verified lost package (after 30 days of no tracking update), or (ii) items received with manufacturing defect substantiated by timestamped photo or video evidence within 48 hours of receipt.

6.3 Buyer Responsibility: We do not refund or replace items due to buyer remorse, address errors, customs issues, or delivery delays within our shipping estimates.

SECTION 7 – DONATION DISCLOSURE AND CHARITY CLARIFICATION

7.1 Voluntary Donation Policy:
Margarets Haven may voluntarily allocate approximately 1% of total gross revenue toward independent animal-related efforts, such as personal or informal projects that support animal welfare. These efforts are funded at our sole discretion and are not affiliated with or verified by any registered charitable organizations. The nature and recipients of these funds may vary over time without prior notice.

7.2 Not a Nonprofit:
Margarets Haven is a privately held, for-profit company. We are not a nonprofit organization, a 501(c)(3), or any form of registered charity. Our donation initiatives are symbolic and promotional in nature and do not imply any official partnership, endorsement, or fiduciary duty on behalf of external organizations or causes.

7.3 No Deductions:
Donations are not tax-deductible, are non-refundable, and should not be interpreted as charitable contributions under tax law. Mentions of shelters, rescues, or animal welfare are expressive themes and do not imply ownership, control, or registration of such entities.

SECTION 8 – DISPUTES, CHARGEBACKS, AND LEGAL REMEDIES

8.1 Chargebacks: You agree not to initiate chargebacks for matters covered by our policies, including final sale, shipping estimates, and symbolic donation references. Doing so constitutes a material breach of this Agreement.

8.2 Legal Enforcement: If you initiate a fraudulent dispute, we reserve the right to present all order data, shipping records, customer communications, and policy disclosures to the payment processor. If the case escalates, we may involve third-party collection agencies, credit reporting services, or pursue small claims action to recover damages and costs.

8.3 Arbitration Requirement: Any unresolved dispute shall be subject exclusively to final and binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. By using our Services, you waive any right to jury trial or class action relief.

SECTION 9 – LIABILITY AND DISCLAIMERS

9.1 As-Is Services: All content, products, and services provided by Margarets Haven are made available on an "as-is" and "as available" basis, without warranties of any kind, express or implied.

9.2 Limited Liability: To the fullest extent permitted by law, Margarets Haven shall not be liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits or data. Our maximum liability shall not exceed the total purchase amount.

SECTION 10 – INDEMNIFICATION AND THIRD-PARTY RELATIONSHIPS

10.1 Indemnity: You agree to defend, indemnify, and hold harmless Margarets Haven and its owners, directors, employees, and partners against any claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from your use of the website, violation of these Terms, or violation of any third-party rights.

10.2 Shopify Indemnity Disclaimer: Shopify is not a party to this Agreement. Any disputes, chargebacks, claims, or legal inquiries must be directed to Margarets Haven exclusively. Shopify shall not be held liable for actions, representations, or omissions by the Company.

SECTION 11 – GOVERNING LAW, JURISDICTION, AND SEVERABILITY

11.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the United States and any applicable state laws, without regard to conflict of law provisions.

11.2 Legal Venue: Any action not resolved by arbitration must be brought in a court of competent jurisdiction within the United States. You consent to personal jurisdiction in such courts.

11.3 Severability: If any provision of these Terms is found to be unenforceable by a court, the remainder of the Terms shall remain in full force and effect.

11.4 Entire Agreement: These Terms represent the entire understanding between you and Margarets Haven and supersede all prior agreements or communications.
